Bland Richter is pleased to announce a defense verdict on all causes of action asserted against the board of directors of a horizontal property regime in a lawsuit which sought the removal of the board and repayment of alleged damages totaling more than $673,000.00. In the matter of COC Corporation, et al. vs. The Bohicket Yacht Club Marina Council of Co-Owners, et al., 2012-CP-10-8214, Bland Richter prevailed on all causes of action ranging from breach of fiduciary duty and self-dealing to accounting and removal of the board of directors. After two days of trial, the trial court found no violations of the Horizontal Property Regime Act and Master Deed as alleged, and further found that the Defendants’ actions were protected by the business judgment rule.
