Catastrophic Injury, Verdicts and Settlements

In a Richland County litigation action, Dinah Cook, as Personal Representative of the Estate of Marth Edens v. RMK Ventures, d/b/a Home Instead, Bland Richter achieved a settlement in the amount of $950,000.00, following the injury and death of Martha Edens, an 88-year-old icon of the South Carolina Republican Party. Ms. Edens had been receiving 24/7 home care services through the Columbia, South Carolina franchise of Home Instead. After suffering a fall in her home, Ms. Edens’ care providers placed her in bed without reporting the fall or resultant injuries. Two days later Ms. Edens was taken to a local hospital where it was discovered that she had suffered bi-lateral femur fractures. After nine months of surgery and rehabilitation, Ms. Edens passed away. Her death certificate attributed the fractures as one of three causes of her death. ( Spring, 2016 )
