Bland Richter successfully defended a large regional home builder sued in a class action in which it was alleged that the homebuilder had systematically misrepresented the square footage of its homes. Bland Richter was first successful in having the cases dismissed from the United States District Court on the strength of arbitration clauses within the sales contracts. The claimants were thereafter forced to arbitrate the claims individually with the AAA. After one year of discovery and the arbitration of the first “test case” before the AAA, Bland Richter obtained a complete defense verdict. The remaining claimants dismissed their cases and no future claims were brought.
